Phoebe Vu Cachuela

Associate—Employment Law

Phoebe Vu Cachuela represents employers in all aspects of employment litigation matters, including discrimination, harassment, wrongful termination, retaliation, wage and hour, and class action and collective matters in state and federal courts.  She has successfully defended clients in various levels of appellate work on both state and federal levels.

Phoebe represents employers and management before the Equal Employment Opportunity Commission, the National Labor Relations Board, the Department of Fair Housing and Employment, and the California Department of Industrial Relations – Division of Labor Standards Enforcement.  She has experience with traditional labor matters, including the representation of employers in unfair labor practice proceedings, grievance arbitrations, Section 301 litigation, and NLRB representation proceedings.

Phoebe also has extensive experience counseling employers, including performing employment and labor audits, workplace investigations, and drafting policy manuals and employee handbooks.

Outside of the office, Phoebe enjoys spending time with her husband and sheepadoodle, powerlifting, and cycling.

Representative Experience

  • Prevailed on motion for summary judgment of FEHA discrimination, FEHA retaliation, and whistleblower retaliation claims against regional health care provider in Superior Court.
  • Obtained favorable finding by Board of Adjustment upholding large grocery chain’s “for cause” termination of a warehouse employee.
  • Defended public entity in suit brought by former employee alleging discrimination based on race, gender, and age.  Oversaw discovery and assisted in developing strategy for negotiating favorable settlement.
  • Successfully briefed and second-chaired oral arguments before the California Supreme Court (Larkin v. W.C.A.B. (City of Marysville) (2015) 62 Cal.4th 152) regarding peace officer’s entitlement to temporary disability benefits in favor of public entity client.
